Spribe's Stance on Intellectual Property Violations
Following a claim from SPRIBE OÜ, the Court of Justice of Pernambuco (TJPE) has issued an injunction against NSX Brasil S.A. concerning the unauthorized use of the “AVIATOR” brand.
Court Ruling
The court granted the request for immediate effect, requiring NSX Brasil S.A to stop using the “AVIATOR” trademark and any signs that are identical or confusingly similar. This includes the reproduction of visual, graphical, or audiovisual elements linked to the claimant’s product. Daily fines have been imposed for non-compliance. This injunction will remain in effect until further decisions are made or a final judgment is rendered regarding the appeal.
The court acknowledged the plausibility of the legal claim based on SPRIBE’s ownership of the “AVIATOR” trademark, which is registered with the National Institute of Industrial Property (INPI). This registration provides the owner exclusive rights throughout Brazil under the Industrial Property Law.
Context of the Dispute
Betnacional is a notable sports betting brand in Brazil, operated by NSX Brasil S.A. This company has recently become part of Flutter Entertainment Plc after its acquisition of a majority stake in the NSX Group. It is important to note that Betnacional was an authorized licensee of SPRIBE from 2022. SPRIBE has expressed loyalty to its clients and values professional relationships; however, it emphasized that it cannot accept violations of its intellectual property.
The legal dispute originated after Betnacional introduced a game named “Aviator,” offered by “Aviator Studio” since 2025. According to allegations from SPRIBE OÜ, this version is considered an unauthorized reproduction of their popular crash game, AVIATOR, which was developed by SPRIBE in late 2018 and has established itself in the global entertainment market.
